EXCLUSIVE ONE YEAR LIMITED PRODUCT WARRANTY
PC Progress provides the following initial 30 day refund
warranty for its X-Theory computer line. For the first 30 days after shipment
of the computer system to Buyer, Buyer shall be entitled to a refund provided
that the Buyer requests and receives an online Return Merchandise Authorization
"RMA" from PC Progresses' website at www.pcprogress.com within the 30
calendar day period after shipment of the merchandise to Buyer. The refund
amount excludes the shipping and handling charges and software pricing.
Buyer is responsible for the shipping and insurance fees for returning
the systems. The returned merchandise must then be received by PC Progress
on the 35th Calendar day after shipment to Buyer to qualify for any refunds.
All returns not conforming to this paragraph shall not be returnable and
shall be governed by the subsequent portions of this Limited Warranty.
The initial 30 day refund warranty shall not apply to any system that:
(1) has been damaged by Buyer; (2) has had hardware replaced, removed,
or modified by any party other than PC Progress; (3) has had any "do not
remove" security labels removed or cracked; or (4) has been operated outside
of the specified system parameters identified for the system. In the event
that the initial 30 day refund warranty does not apply, the systems shall
not be returnable and Buyer’s exclusive warranty shall be the governed
by the subsequent section of this Limited Warranty.
Upon the expiration of 30 calendar days after shipment of the system to
Buyer, or upon the occurrence of any the four exclusions in the preceding
paragraph, the warranty is as follows. PC Progress warrants its computer
systems for a period of one year from the purchase date which begins on
the date on your dated sales receipt. During this warranty period, PC
Progress shall repair or replace any defective internal system components
at its discretion. These repairs may be made with new, used, or reconditioned
parts. The replaced parts shall upon replacement become the property of
PC Progress.
In order to obtain service, Buyer must comply with PC Progress’ Online
Return Merchandise Authorization ("RMA") procedure outlined on its website
at www.pcprogress.com. Once an RMA is issued, the Buyer shall at his or
her expense ship the system in its original packaging to PC Progress and
shall assume the risk of loss or damage in transit. Buyer must back up
all data and programs and remove any proprietary or confidential data
before returning the system to PC Progress for service. PC Progress shall
not assume responsibility of any loss of data or damage to loaded computer
programs on Buyer’s system.
THIS LIMITED WARRANTY IS THE SOLE WARRANTY MADE BY PC PROGRESS REGARDING
ITS COMPUTER SYSTEMS. PC PROGRESS MAKES NO OTHER EXPRESS OR IMPLIED WARRANTIES
INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, AND FITNESS FOR A
PARTICULAR PURPOSE. IN NO EVENT SHALL PC PROGRESS BE LIABLE FOR ANY LOSS
OF PROFIT OR ANY COMMERCIAL DAMAGE, INCLUDING BUT NOT LIMITED TO SPECIAL,
INCIDENTAL, CONSEQUENTIAL, OR OTHER DAMAGES. Some jurisdictions do not
allow the exclusion of limitation of liability for consequential or incidental
damages. You are advised to consult applicable state or country laws for
a full determination of your rights.
